Public Roadway Regulation

A.R.S. Section 33-1818 requires the Association to conduct a vote in order to retain the ability to regulate public roadways. First, at least one-tenth of the Members must vote. Second, at least a majority of the Members voting must vote in favor of retaining the right to regulate public roadways. If the Association does not obtain enough votes, it will forever lose the ability to regulate public roadways. This means that the Association would lose the right to enforce any street parking restrictions as well as any other restrictions related to public roadways unless enough Members vote to retain such restrictions
 
  • Vote ‘yes’ for retaining the Association’s authority to continue regulating the use of the public roadways within the community.
  • Vote ‘no’ against retaining the Association’s authority to continue regulating the use of the public roadways within the community.
 
A quorum is the minimum number of members required to be present to officially conduct business or hold a vote at a meeting. For this community, which has 2,147 lots, a 10% quorum means that at least 215 lots (10% of 2,147) need to participate in the vote or meeting to proceed and be valid. This is according to the Bylaws 2.4 – Quorum.
 
This participation can include homeowners who vote electronically, vote with an Absentee ballot in the Ironwood Room, or before the meeting on Thursday, March 27. If fewer than 215 lots are represented, the quorum requirement will not be met, and the vote cannot take place.
 
We encourage all homeowners to participate to ensure we can move forward with important community decisions.
 

TIMELINE
 
Voting is scheduled to start on Monday, March 3, 2025. 
  • Online voting and Absentee voting ends on Monday, March 24, 2025, at noon.
  • In-person voting will open at 5:30 p.m. and close at 6 p.m. on Thursday, March 27, 2025, at the Open Board Meeting.
  • The results will be announced at the Thursday, March 27, 2025, Open Board Meeting by the Ballot Committee.
BALLOT COMMITTEE
 
We’re seeking three (3) residents in good standing to serve on the Ballot Committee for the Regulation of Public Roadways vote. The committee will handle ballot verification and counting during the Open Board Meeting on Thursday, March 27, 2025.
 
Members must attend:
  • Ballot verification/counting on 3/27 at 2:00 p.m. in the Ironwood Room.
  • The Open Board Meeting on 3/27 starting at 5:30 p.m. to verify and announce results.
  • Service begins upon Board appointment at the February 27 Board Meeting and concludes at the March 27 Board Meeting.
The Ballot Committee Application must be completed, signed, and submitted to the Ironwood Crossing Management Team either in person at the office or via email at ironwoodcrossing@ccmcnet.com.
 
 
HOW TO VOTE
 
You may cast your vote for the regulation of Public Roadways in one of the three ways;
  1. You may vote using the Absentee Ballot.
  2. You may vote online.
  3. You may attend the 3/27 Open Session Board Meeting and vote in person using the Meeting Ballot. 
If you choose to vote by Absentee Ballot, you can return the ballot in person to the Association Office, or via email to ironwoodcrossing@ccmcnet.com.The Absentee Ballot must be received no later than Monday, March 24, 2025, at noon. Arizona time in order to be counted. Any Absentee Ballots returned after Monday, March 24, 2025, at noon Arizona time will not be counted.   
 
This vote will be administered by Vote HOA Now. You will receive a separate email from Vote HOA Now with voting instructions closer to the opening of the vote. More information on voting will be sent out via special e-blasts and weekly newsletters. Electronic voting is safe, easy, and preferred.

**Please note that only the primary email on the account Lot will receive the electronic invitation to vote.**

Alternatively, you may choose to attend the 3/27 Open Session Board Meeting and cast your vote in person using a Meeting Ballot (if you have not previously voted). 
 
ADDITIONAL INFORMATION
 
Each Lot shall have one vote. Please only cast one vote per Lot. In the event more than one vote is cast for a particular Lot, none of said votes shall be counted and all said votes shall be deemed void. Thus, if you vote online and by absentee ballot, none of your votes will count. Once you vote in any manner, the vote is irrevocable and cannot be changed.
 
A quorum shall be constituted by Members entitled to cast one-tenth (1/10th) of the Eligible Votes. Your vote will not count if you are delinquent in the payment of Assessments or other amounts due to the Association at 5:00 p.m. on February 27, 2025.

TOWN HALL
 

A Town Hall open to the members will be held on Wednesday, February 12, 2025 at 6 p.m. The meeting will be held at Legacy School Cafeteria (41800 N. Barnes Pkwy, Queen Creek, AZ). Check-in begins at 5:30 p.m. The purpose of the Town Hall is to inform the membership about ARS 33-1818, which addresses the regulation of public roadways within communities.
